You are requesting retroactive Design Review approval to construct decks, a 240-square-foot, detached accessory structure and retaining walls on a lot developed with a single-family residence in San Rafael. The proposed development would not result in an increase in the existing floor area ratio of approximately 14.99-percent on the 20,000-square-foot lot. The proposed structures would reach the following maximum heights as measured from existing grade: (1) decks-7.9 feet; (2) retaining walls-4.9 feet; and (3) detached accessory structure-16 feet. The structures would have the following setbacks: (1) decks-82 feet from the west front property lines; 34.5 feet from the south side property line; 44 feet from the north side property line; and 82 feet from the east rear property line; (2) retaining walls-over 100 feet from the west front property line; 44 feet from the south side property line; 45 feet from the north side property line; and 68 feet from the east rear property line; and (3) detached accessory structure: 88 feet from the west front property line; 15 feet from the south side property line; 60 feet from the north side property line; and 69 feet from the east rear property line. Various site improvements would also be entailed in the proposed development, including installation of an outdoor kitchen, turf area, outdoor gas fire place and stone patio.
Design Review approval is required because the project involve new construction in a planned development district pursuant to Marin County Development Code Section 22.42.020(A).
