Board Plans Vote on Delivery-Only Medicinal Cannabis Licensing

New ordinance a better fit for the community

San Rafael, CA – Now that several key alterations have been made over the past few weeks, a delivery-only medicinal cannabis licensing ordinance is getting its due before the Marin County Board of Supervisors at 1:30 p.m. Tuesday, November 14.

The proposed licensing ordinance establishes a regulatory framework and local delivery options for patients to safely access medicinal cannabis consistent with a state law approved in June. The ordinance is officially called the Medicinal Cannabis Delivery-Only Retailer (MCDORe) Licensing ordinance.

The ordinance would require a retailer to be closed to the public and dispense medicinal cannabis exclusively by delivery – a significant change from the dispensary ordinance approved in December 2015. Such retailers would have to be located at least 600 feet from schools, day-care centers, youth centers and playgrounds. Locations could be within industrial-zoned and office properties in addition to commercially zoned districts. More details about the changes are available in the staff report.

If approved, the MCDORe ordinance would replace the dispensary ordinance adopted in 2015. Like the existing one, the new ordinance would only affect medicinal cannabis regulations in the unincorporated areas of Marin; towns and cities create regulations in their own jurisdictions, although only Fairfax has a permitted medicinal cannabis business in operation.

The merit hearing for the ordinance will take place in the Board chamber, Suite 330 of the Civic Center, 3501 Civic Center Drive, San Rafael.
